ChessMinds is an interactive chess analysis platform that provides:

• Free Tier: Basic chess gameplay with Stockfish engine analysis and local game storage for anonymous users.
• Premium Tier: Subscription-based service offering AI-powered move analysis, unlimited cloud game storage, game history access, and cross-device synchronization.

3. User Accounts

3.1 Account Creation

To access premium features, you must subscribe and create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account access. We use passwordless authentication via magic links sent to your email. You must notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activities.

4. Subscription and Payment

4.1 Subscription Plans

Premium subscriptions are billed on a recurring basis (monthly or as otherwise specified). You will be charged at the beginning of each billing cycle for the upcoming period.

4.2 Payment Processing

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method for all fees incurred.

4.3 Cancellation and Refunds

You may cancel your subscription at any time through the Stripe customer portal. Cancellations will take effect at the end of the current billing period. We do not provide refunds for partial billing periods except as required by law.

4.4 Price Changes

We reserve the right to change subscription prices with at least 30 days' notice. Price changes will apply to subsequent billing cycles.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with others
• Use the Service to transmit malicious code or harmful content
• Violate the intellectual property rights of others

6. Intellectual Property

The Service and its original content, features, and functionality are owned by ChessMinds and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Rights

You retain ownership of the chess games you create and play using the Service. By using the Service, you grant us a license to store and process your game data to provide the Service to you.

6.3 Third-Party Components

The Service uses third-party components including Stockfish (open-source chess engine) and OpenAI (AI analysis). These components are subject to their respective licenses and terms.

7. AI-Generated Content

Our premium AI analysis feature uses artificial intelligence to provide move explanations and strategic insights. While we strive for accuracy, AI-generated content may occasionally contain errors or subjective interpretations. The analysis is provided for educational purposes and should not be considered professional chess instruction.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• The quality of any analysis or recommendations will meet your expectations
• Any errors in the Service will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHESSMINDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

You agree to indemnify, defend, and hold harmless ChessMinds and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.
